MIAMI COUNTY — Patrick Anthony, 57, of Piqua, was sentenced to serve two concurrent six years prison sentences for one count of first-degree felony complicity rape and one count of first-degree kidnapping of a Tipp City woman with Down syndrome in June 2014.
Anthony entered a guilty plea in exchange for a joint plea agreement with prosecution. As part of the deal, Anthony will not be eligible for early or judicial release.
Miami County Common Pleas Court Judge Christopher Gee also sentenced Anthony to serve 24 months per count for two counts of third-degree felony complicity to intimate witnesses charges related to the case. The sentence will run concurrent with the six-year sentence.
Gee also noted the injury to the victim was made worse due to her mental age.
Upon Anthony’s release from prison, he must register as a Tier III sex offender for life. He also must serve five years of mandatory post-release control. Anthony received 236 days of jail credit.
Anthony did not make a statement at his sentencing.
Miami County Prosecutor Tony Kendell said the victim’s family understands the challenges of the case. Kendell also said the number of years Anthony will serve in prison “is just under the circumstances.”
The female victim, now 32, of Tipp City, has Down syndrome and was found mentally incompetent to stand trial.
According to the report, the victim was picked up at her home by friends the evening of June 27, 2014, and returned home the following morning, which was unusual, according to the victim’s mother.
The following day, the victim’s mother answered the victim’s phone and co-defendant Harry S. Reedy 59, of Piqua, identified himself and informed her that the victim had been with him overnight and that they had had sex. The victim then told her mother that Reedy raped her at a Troy residence. The victim also stated two men, including Reedy, had raped her while two others, Trishica Leighly, 37, and Anthony had held her down while handcuffed to a bed.
Reedy plead guilty to first-degree felony rape and a charge of gross sexual imposition. Reedy was sentenced to serve eight years in October.
Leighly entered a plea of no contest to four counts of third-degree felony intimidation of witnesses on Oct. 22. Leighly was sentenced to 12 months in prison for her role in November.
